HomeMy WebLinkAboutCity Council Resolution 2022-256 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-256 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENTS FOR R ETAINING W ALLS AT V ARIOUS P ROPERTIES WITHIN A SPEN H OLLOW, A SPEN H OLLOW 2 ND, AND A SPEN H OLLOW 3 RD WHEREAS, the developer, Pulte Homes, on behalf of various property owners has requested the City approve an encroachment agreement allowing a retaining wall within drainage and utility easements; and WHEREAS, the following addresses are included in the developer’s request: 16825 56th Avenue N 16815 56th Avenue N 16715 56th Avenue N 16912 56th Avenue N 16805 56th Place N 5415 Fountain Lane N 5435 Fountain Lane N 5385 Fountain Lane N 5375 Fountain Lane N 5715 Fountain Lane N; and WHEREAS, the properties are legally described as: Lot 10, Block 2, Aspen Hollow Lot 11, Block 2, Aspen Hollow Lot 16, Block 2, Aspen Hollow Lot 21, Block 3, Aspen Hollow Lot 19, Block 3, Aspen Hollow Lot 7, Block 2, Aspen Hollow 2nd Addition Lot 9, Block 2, Aspen Hollow 2nd Addition Lot 11, Block 1, Aspen Hollow 3rd Addition Lot 12, Block 1, Aspen Hollow 3rd Addition Lot 11, Block 1, Aspen Hollow; and WHEREAS, the encroachment agreement permits only the identified retaining walls within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreements allowing a retaining wall within drainage and utility easements located at 16825 56th Avenue N, 16815 56th Avenue N, 16715 56th Avenue N, 16912 56th Resolution 2022-256 Page 2 Avenue N, 16805 56th Place N, 5415 Fountain Lane N, 5435 Fountain Lane N, 5385 Fountain Lane N, 5375 Fountain Lane N, and 5715 Fountain Lane N are approved. APPROVED by the City Council on this 25th day of October, 2022.
