HomeMy WebLinkAboutCity Council Resolution 2022-215 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-215 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT FOR A R ETAINING W ALL ON P ROPERTY LOCATED AT 5245 N IAGARA L ANE N ORTH WHEREAS, Robert Thomas Homes Inc, on behalf of property owners Erik S Pederson and Tiffany Pederson, has requested the City approve an encroachment agreement allowing a retaining wall within drainage and utility easements at 5245 Niagara Lane North; and WHEREAS, the property is legally described as: Lot 1, Block 2, Hampton Hills 4th Addition; and WHEREAS, the encroachment agreement permits only the retaining wall within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreement allowing a retaining wall within drainage and utility easements located at 5245 Niagara Lane North is approved. APPROVED by the City Council on this 30th day of August, 2022.
