HomeMy WebLinkAboutCity Council Resolution 2022-193 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-193 A R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT FOR P ROPERTY L OCATED AT 16000 41 ST A VENUE (2022044) WHEREAS, Independent School District 284 has requested approval of a conditional use permit to allow an educational facility use in the RSF-2 (single family detached 2) zoning district at 16000 41st Avenue; and WHEREAS, the subject property is legally described as: Lot 5, Block 1, Willow Meadows 2nd Addition, and that part of the northerly one-half of 41st Avenue North, as dedicated in the Plat of Willow Meadows 2nd Addition, lying east of the southerly extension of the west line of Lot 5, Block 1, Willow Meadows 2nd Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Independent School District 284 for a conditional use permit to allow an 8,517 square foot educational facility use in RSF-2 (single family detached 2) zoning district for 16000 41st Avenue, subject to the following findings and conditions: 1. A conditional use permit is approved in accordance with the application received by the City on May 26, 2022, with additional information on June 6, 2022, June 7, 2022, June 22, 2022, and June 24, 2022, except as may be amended by this resolution. 2. The requested conditional use permit is approved with the findings that all applicable conditional use permit standards would be met, as outlined in the zoning ordinance. 3. A complete building code analysis is required to be completed by a MN licensed architect. 4. Building code-related items will be addressed under the building permit application submittal. 5. A Sewer Availability Charge (SAC) determination letter is required from the Metropolitan Council. 6. Revise the plans to meet fire requirements as follows: a. UL certificate required on the fire alarm system. b. All rooms must be labeled for their use. c. Fire sprinkler and fire alarm systems must be up to date with annual inspection. d. Fire lane signage shall be provided in locations as approved and field identified by the fire inspector. Resolution 2022-193 (2022044) Page 2 7. Standard Conditions: a. Any signage shall require issuance of separate sign permits and comply with the City sign regulations. b. Compliance with the City’s lighting regulations. c. All parking shall be off-street in designated parking spaces. d. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
