HomeMy WebLinkAboutCity Council Resolution 2022-187 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-187 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT FOR R ETAINING W ALLS WITHIN D RAINAGE AND U TILITY E ASEMENTS WITHIN T HE P INES AT E LM C REEK N EIGHBORHOOD WHEREAS, David Weekly Homes, on behalf of the Pines at Elm Creek Association, has requested the City approve an encroachment agreement allowing retaining walls within drainage and utility easements within The Pines at Elm Creek development; and WHEREAS, the properties are legally described as: Lots 1, 2, 5, and 6, Block 1 and Lots 13, 14, 15, Block 2, The Pines at Elm Creek; and Lots 9 and 10, Block 2, The Pines at Elm Creek 2nd Addition; and WHEREAS, the encroachment agreement permits only the retaining walls within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that one or multiple structures need to be removed in the future, it will be at the homeowner association’s expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreement allowing retaining walls within drainage and utility easements within The Pines at Elm Creek neighborhood is approved. APPROVED by the City Council on this 26th day of July, 2022.
