R ESOLUTION A PPROVING S PECIAL A SSESSMENT A GREEMENT AND
A DOPTING A SSESSMENT FOR 17405 45 TH A VENUE N AS PART OF THE
P INEVIEW L ANE AND P LUM T REE E AST R EHABILITATION P ROJECT (ST229002)
WHEREAS, the City noticed, held a public improvement hearing, and ordered the improvements for the
Pineview Lane and Plum Tree East Rehabilitation Project (“Project”) on April 26, 2022; and
WHEREAS, the City noticed and held an assessment hearing for the Project on April 26, 2022; and
WHEREAS, following the assessment hearing the City Council adopted the assessment roll for the Project

with the Wyndemere Farms Homeowners Association, Inc. (“Property Owner”) property at 17405 45 Avenue
N (PID 811822330003) removed so further discussion could be held at the May 10, 2022 meeting; and
WHEREAS, the City has been asked to approve a public improvement and special assessment agreement
(“Agreement”) between the City and which would delay certifying the assessment roll for the subject property
until 2023.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA:
1. The public improvement and special assessment agreement with the Property Owner is approved,
and the Mayor and City Manager are authorized and directed to sign the agreement.
2. The special assessment against Property Owner in the assessment roll and Agreement adopted by
this resolution is $5,000.00 and is hereby approved to be levied.
3. Such assessment shall be due and payable before the end of 2023 with 0% interest.
4. The Agreement must be fully executed by October 31, 2022, to be valid.
5. The Clerk shall transit a certified duplicate of this assessment to the County to be extended on the
proper tax lists of the County and such assessments shall be collected and paid over in the same
manner as other municipal taxes.
