HomeMy WebLinkAboutCity Council Resolution 2022-143 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-143 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND C ONDITIONAL U SE P ERMIT A MENDMENT FOR Z ACHARY P LAYFIELDS FOR P ROPERTY L OCATED AT THE N ORTHWEST Q UADRANT OF C OUNTY R OAD 9 AND Z ACHARY L ANE, PID N UMBER 14-118-22-11-0007 (2022031) WHEREAS, the City of Plymouth has requested approval of a site plan amendment and conditional use permit amendment to add pickleball courts and additional outdoor athletic field lights at Zachary Playfields for the property presently legally described as follows: Lot 2, Block 2, City of Plymouth Plat Number 2, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth for a site plan amendment and conditional use permit amendment to add pickleball courts and additional outdoor athletic field lights at Zachary Playfields, subject to the following conditions: 1. A site plan amendment is approved to allow six pickleball courts, enclosed by a fence, and associated outdoor athletic lights between the existing ballfields and west of the parking lot, in accordance with the plans received by the city on April 8, 2022, except as amended by this resolution. 2. A conditional use permit amendment is approved to allow additional outdoor athletic court lights, pursuant to section 21105.06, subd. 7 of the zoning ordinance, in accordance with the plans received by the city on April 8, 2022, except as amended by this resolution. 3. A separate electrical permit is required prior to the installation of the light poles and fixtures. 4. A separate building permit is required for the eight-foot-high fencing enclosing the pickleball courts. 5. Prior to the issuance of any permits, the applicant shall: a. Obtain City approval of final construction plans, including any applicable stormwater treatment plans. b. Obtain any required permits from the Bassett Creek watershed district. c. Provide fixture details demonstrating fully shielded luminaires, and if required, side shielded and internally shielded luminaires that are installed in a fashion that maintains Resolution 2022-143 File 2022031 Page 2 the shielding characteristics unless certified in writing by a registered engineer or by a certified lighting professional that such shielding is impractical. d. Confirm that the fixtures have received every reasonable effort to mitigate light trespass and light pollution, supported by a signed statement from a registered engineer or by a certified lighting professional describing the mitigation measures. 6. Any new proposed exterior lighting fixtures shall meet current zoning ordinance standards pursuant to section 21105.06 of the ordinance. 7. Standard Conditions: a. Silt fence shall be installed prior to any construction on the site. b. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. c. The site plan amendment and conditional use permit amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21015.07 and 21045.09, respectively, of the zoning ordinance.
