HomeMy WebLinkAboutCity Council Resolution 2022-127 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-127 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND V ARIANCE FOR E AGLE R IDGE P ARTNERS FOR P ROPERTY L OCATED AT 5905 T RENTON L ANE (2022006) WHEREAS, Eagle Ridge Partners has requested approval of a site plan amendment and variance for the expansion of the parking lot and related improvements for the property legally described as follows: Lot 1, Block 2, Bass Creek Business Park Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Eagle Ridge Partners for a site plan amendment and variance for the expansion of the parking lot and related improvements for property located at 5905 Trenton Lane, subject to the following conditions: 1. A site plan amendment is approved to allow a parking lot expansion for the addition of up to 162 parking spaces and related site improvements, in accordance with the plans received by the city on January 11 and 12, 2022, and additional information on February 9 and 11, 2022, except as amended by this resolution. 2. Variances are approved to allow: 1) additional impervious surface, beyond existing 28 percent, on the portion of the property within the shoreland overlay district of Bass Creek; and 2) less square- footage than required of interior parking lot landscaping islands, with the finding that the request complies with all applicable variance standards. 3. A separate grading permit is required prior to commencement of the project. 4. Prior to issuance of the grading permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit the related financial guarantees and fees pursuant to section 21045.10 of the zoning ordinance. b. Obtain the required permit from the Shingle Creek watershed district. c. Execute and record a maintenance agreement for all required best management practices (BMP’s). d. Obtain encroachment for any retaining walls located within the drainage and utility easements. Otherwise, revise plans to remove any proposed retaining walls within any drainage and utility easements. Res. 2022-127 File 2022006 Page 2 e. Revise the plans to construct any new parking spaces within the shoreland overlay district for Bass Creek as permeable pavement and execute and record a maintenance agreement for the best management practice. f. Obtain city approval of final construction plans, including the stormwater treatment plan. g. Revise the plans as follows: i. Revise the landscaping plan to stagger the coniferous trees and shrubs to increase spacing, and substitute ornamental trees as opposed to overstory trees, within the parking lot islands pursuant to section 21130 of the zoning ordinance. In addition, show tree protection fencing for the trees located at the top of the hill on the west side of the property. ii. Provide a luminaire plan (electrical site plan) in conformance to the exterior lighting requirements for LZ2 (light zone 2) for any new parking lot lighting or wall mounted fixtures. The plan should include the proposed lumens per square feet of hardscape (maximum 2.5 lumens per square foot of hardscape). See section 21005 definitions section under Lighting Related for applicable definitions. iii. Provide exterior lighting fixture details that include the backlight, uplight, glare (B.U.G.) information, and correlated color temperature (CCT) information. 5. Silt fence shall be installed prior to any construction on the site. 6. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 7. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 8. Standard conditions: a. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. b. No trees shall be planted in the public right-of-way or drainage and utility easements. c. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a minimum 42-inch high fence shall be installed at the top of retaining walls that exceed four feet in height. d. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. The site plan amendment and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21030.06, of the zoning ordinance.
