HomeMy WebLinkAboutCity Council Resolution 2022-124 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-124 R ESOLUTION A PPROVING A P ARTIAL R ELEASE OF R ECORDED C ITY C OUNCIL A CTIONS WHEREAS, Plymouth Presbyterian Church (“PPC”) operates a place of assembly at the property previously legally described as Lot 1, Block 1, Plymouth Presbyterian Church, according to the recorded plat thereof, Hennepin County, Minnesota (“PPC Property”); and WHEREAS, the City has issued several conditional use permits, site plan approvals, variances and encroachment permits since 1994 for the activities associated with PPC’s operations (collectively, the “City Council Actions”); and WHEREAS, PPC, together with Invest Plymouth I, LLC, has combined the PPC Property with adjacent land into the plat of Parkera Plymouth Addition, Hennepin County, Minnesota (“Parkera Plat”); and WHEREAS, the Parkera Plat eliminated the previous description of the PPC Property, and PPC will continue to operate on a smaller lot legally described as Lot 1, Block 1, Parkera Plymouth Addition, Hennepin County, Minnesota (“New PPC Property”); and WHEREAS, PPC and Invest Plymouth I, LLC seek to partially release the remaining lots within the Parkera Plat from any of the City Council Actions, which apply only to PPC on the New PPC Property; and WHEREAS, the City Council has determined that the remaining parcels in the Parkera Plat shall be released from the City Council actions that only affect PPC. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that Lot 2, Block 1; Lot 3 Block 1; and Outlot A, Parkera Plymouth Addition, Hennepin County, Minnesota shall be released from the following City Council Actions: 1. Resolution No. 94-256 Approving a Site Plan and Conditional Use Permit for Plymouth Presbyterian Church and Site Improvement Performance Agreement (unrecorded), dated May 2, 1994, recorded July 14, 1994 as Doc. No. 6312810. 2. Resolution No. 2004-193 Approving a Site Plan Amendment and Variance for the Construction of a Playground, dated June 4, 2004, recorded June 17, 2004, as Document No. 8378970. 3. Resolution No. 2006-087 Approving a Site Plan Amendment, Conditional Use Permit Amendment, and Variance to Allow an Addition at Plymouth Presbyterian Church, dated March 7, 2006, recorded March 14, 2006, as Document No. 8763167. 4. Encroachment Agreement for a Steel Cross by and between the City of Plymouth, a Minnesota municipal corporation and Plymouth Presbyterian Church, a Minnesota non-profit corporation dated October 10, 2006, recorded, October 30, 2006, as Document No. 8885513. Resolution No. 2014-161 Approving a Conditional Use Permit for Wayzata Public Schools Community Education to Operate a Daycare/Home Base Bright Start Program out of the Plymouth Presbyterian Church, recorded May 29, 2014 as Document No. A10082924. 6. Resolution No. 2018-333 Approving a Conditional Use Permit for Bloom Early Learning to Operate a Daycare at Plymouth Presbyterian Church recorded October 25, 2018 as Document No. A10605433. 7. Encroachment Agreement by and between the City of Plymouth and Plymouth Presbyterian Church dated April 2, 2019, recorded April 5, 2019 as Document No. A10648426. BE IT FURTHER RESOLVED that the City Clerk shall be directed to record this resolution against the plat of Parkera Plymouth Addition, Hennepin County, Minnesota.
