RESOLUTION NO. 2022-095
RESOLUTION APPROVING ENCROACHMENT AGREEMENT
FOR A RETAINING WALL ON PROPERTY LOCATED AT
6040 KIMBERLY LANE NORTH
WHEREAS, David Weekly Homes, on behalf of property owners Mark Otero and Zulma Enid
Beniquez Chico, has requested the City approve an encroachment agreement allowing a retaining wall
within drainage and utility easements at 6040 Kimberly Lane North; and
WHEREAS, the property is legally described as:
Lot 009, Block 003, The Pines at Elm Creek; and
WHEREAS, the encroachment agreement permits only the retaining wall within the easements
and all related facilities must still meet all applicable City codes ; and
WHEREAS, as stated in the encroachment agreement, if the City requests that the structure
needs to be removed in the future, it will be at the property owners’ expense.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the encroachment agreement allowing a retaining wall within drainage and utility
easements located at 6040 Kimberly Lane North is approved.
APPROVED by the City Council on this 22nd day of March, 2022.
