R ESOLUTION N O. 2022-052
R ESOLUTION A PPROVING THE V ACATION OF A P ORTION OF D RAINAGE AND U TILITY
E ASEMENT OF L OT 1, B LOCK 1, P LYMOUTH P RESERVE
WHEREAS, a public hearing with respect to said vacation was scheduled for February 22, 2022,
in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of February 22, 2022; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council held a public hearing on February 22, 2022 to inform any and all
interested parties relevant to the vacation of a portion of the Drainage and Utility Easement of Lot 1,
Block 1, Plymouth Preserve; and
WHEREAS, it was determined by the City Council that said Drainage and Utility Easement is not
needed for public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the following Drainage and Utility Easement be vacated:
To vacate that part of the 6 foot wide drainage and utility easement as dedicated on Lot 1, Block 1,
PLYMOUTH PRESERVE, according to the recorded plat thereof, Hennepin County, Minnesota which lies
adjacent to the West line of said Lot 1, except the North 6 feet thereof and except the Southerly 10 feet
thereof.
BE IT FURTHER RESOLVED that recording of this vacation resolution shall be accomplished with
the recording of the replacement Drainage and Utility Easement granted by the petitioner.
