HomeMy WebLinkAboutCity Council Resolution 2022-042 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-042 A R ESOLUTION A PPROVING AN E IGHT-Y EAR E XTENSION TO THE E XISTING C ONDITIONAL U SE P ERMIT AND MINOR SITE CHANGES TO THE M ASTER P LAN FOR P ROVIDENCE A CADEMY, 15100 S CHMIDT L AKE R OAD (2021098) WHEREAS, Studio 55 Architects has requested an eight-year extension to the existing conditional use permit and minor site changes to the master plan for Providence Academy located at 15100 Schmidt Lake Road; and WHEREAS, the subject property is legally described as Lot 1, Block 1, Providence Academy, Hennepin County, Minnesota; and WHEREAS, without any action, the current conditional use permit – for future improvements indicated on the master plan that have not yet been constructed -- expires on June 25, 2022; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the requested eight-year extension to the existing conditional use permit and minor site changes to the master plan for Providence Academy located at 15100 Schmidt Lake Road, subject to the following conditions: 1. The conditional use permit – for future improvements indicated on the master plan (as may be amended) that have not yet been constructed – is hereby extended for an additional eight-year term, such that it is now valid until June 25, 2030, based on the finding that the applicable conditional use permit standards have been met. 2. The master plan is hereby amended to incorporate the minor site changes, in accordance with the plans received by the City on December 13, 2021, except as may be amended by this resolution. 3. All previous approvals and related conditions for Providence Academy shall remain in full force and are hereby incorporated by reference, including those specified in: Resolution 99-478; Resolution 2000-005; Resolution 2000-144: Resolution 2005-004; Resolution 2008-148; Resolution 2013-197; Resolution 2015-104; Resolution 2015-328; Resolution 2021-242; and any approved minor site plan modifications. 4. Prior to commencement of site work, the owner shall: a. Obtain any necessary grading or building permits. b. Obtain City and watershed approval of final construction plans. Resolution 2022-042 (2021098) Page 2 5. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals pursuant to ordinance provisions. b. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. c. This approval shall expire on June 25, 2030, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to further extend the expiration date, as regulated under the zoning ordinance.
