HomeMy WebLinkAboutCity Council Resolution 2022-037 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-037 R ESOLUTION A PPROVING S ITE P LAN AND V ARIANCE FOR E NDEAVOR D EVELOPMENT FOR R EDEVELOPMENT OF 5005 N ATHAN L ANE WITH AN O FFICE/W AREHOUSE B UILDING (2021076) WHEREAS, Endeavor Development LLC has requested approval of a site plan and variance to allow redevelopment of 5005 Nathan Lane with a 90,000 square foot industrial office/warehouse building to be called “Nathan Lane Business Center” on the six-acre site legally described as Lot 6, Block 1, Ryan Business Center, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Endeavor Development LLC for a site plan and variance for redevelopment of property located at 5005 Nathan Lane, subject to the following conditions: 1. A site plan is approved to allow construction of a 90,000 square foot office/warehouse building and related site improvements, in accordance with the plans received by the City on November 12, 2021, except as may be amended by this resolution. 2. A variance is approved to allow reduced drive aisle setback (5 feet instead of 15 feet) along the north lot line, with the finding that all applicable variance standards are met. 3. Demolition and building permits are required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Obtain City approval of final construction plans. b. Complete a site improvement performance agreement (SIPA) and submit the related financial sureties. c. Obtain any required permits and/or approvals from the watershed district. d. Provide a maintenance agreement for drainage system. e. Provide a revised lighting plan indicating compliance with the City’s lighting regulations, including but not limited to those for curfew, BUG rating, and house-side shielding. 5. Silt fence shall be installed prior to any grading or construction work on the site. 6. The applicant would need to repair any damage that occurs to existing trails abutting the site, in accordance with City standards. Resolution 2022-037 File 2021076 Page 2 7. Building code related items will be address upon submittal of a building permit application. A sewer availability charge (SAC) determination letter from the Metropolitan Council is required in conjunction with submission of the building permit application. 8. Accessible routes from the accessible parking spaces to the accessible building entrances cannot exceed a slope of 1:20 and shall be identified on the plans. 9. Based on the overall number of parking spaces to be provided on the site, five accessible parking spaces would be required. 10. Retaining walls over four feet in height require a separate building permit and design by a structural engineer. 11. Standard Conditions: a. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. b. Any visible rooftop or ground-mounted mechanical equipment shall be painted or screened to match the building. c. Fire lane signage shall be provided in locations to be field identified by the fire inspector. d. Fire hydrants, hydrant valves, post-indicators valves, address directional signage, and fire department connections shall be placed in locations as approved by the fire inspector. e. Turning radius evaluation shall be submitted to the fire inspector for review and approval. f. The applicant shall remove any diseased or hazardous trees. g. No trees may be planted in the public right-of-way. h. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. i. The site plan and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06, respectively, of the zoning ordinance.
