R ESOLUTION A PPROVING C ONDITIONAL U SE P ERMIT FOR P ROPERTY
L OCATED AT 9805 45 TH A VENUE (2021100)
WHEREAS, Opportunity Partners has requested approval of a conditional use permit to allow an
educational licensed daycare use within the existing building located at 9805 45th Avenue; and
WHEREAS, the property is legally described as:
That part of Lots 1 and 3, Block 1, Meyer Gonyea Addition lying West of a line drawn
parallel with and distant 44.00 feet West of the West line of Lot 2 of said Block 1 and its
Southerly extension and lying North of the North line of Lot 5 of said Block 1 and its Easterly
extension, according to the plat thereof on file in the office of the County Recorder in and
for Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and
recommends approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request by Opportunity Partners for a
conditional use permit to allow an educational daycare use at 9805 45th Avenue, subject to the
following conditions:
1. A conditional use permit is approved in accordance with the application received by the City on
November 24 and December 17, 2021, except as may be amended by this resolution.
2. A separate building permit is required prior to the commencement of the project. Building code-
related items will be addressed under the building permit.
3. Prior to occupancy, the applicant shall obtain any required licenses and permits from the Minnesota
Department of Human Services.
4. The requested conditional use permit is approved with the findings that all applicable conditional
use permit standards would be met, as outlined in the zoning ordinance.
5. Standard Conditions:
a. Any subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
b. The conditional use permit shall expire one year after the date of approval, unless the property
owner or applicant has started the project, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date for up
to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
