R ESOLUTION N O. 2022-012
R ESOLUTION A PPROVING A CQUISITION OF E ASEMENTS F ROM J UDY AND L EONARD L UEDKE
FOR THE C OUNTY R OAD 47 P HASE 1 R ECONSTRUCTION P ROJECT (ST220001)
WHEREAS, the City requires permanent and temporary easements for construction of
improvements with the County Road 47 Phase 1 Project (ST220001); and
WHEREAS, Leonard and Judy Luedke of Minnesota, is grantors “Owners” of real property
located within the City of Plymouth as legally described as West 516 feet of the East 1841 feet of the
North Half of the Northeast Quarter of Section 6, Township 118 North, Range 22 West, Hennepin
County, Minnesota lying northerly of the northerly right-of-way of HENNEPIN COUNTY RIGHT-OF-WAY
NO. 47 PLAT 13 and southerly of the following described line and its northwesterly and easterly
extensions; and
WHEREAS, Leonard and Judy Luedke of Minnesota, is grantors “Owners” of real property
located within the City of Plymouth as legally described as West 643 feet of the East 1325 feet of the
North 1/2 of the Northeast Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota
lying northerly of the northerly right-of-way of HENNEPIN COUNTY RIGHT OF WAY NO. 47 PLAT 13 and
southerly of the following described line and its easterly and westerly extensions; and
WHEREAS, Leonard and Judy Luedke of Minnesota, is grantors “Owners” of real property
located within the City of Plymouth as legally described as East 682 feet of the Northeast Quarter of the
Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian,
EXCEPTING 1.25 acres heretofore conveyed to School District No. 120, Hennepin county, Minnesota,
situated in the Southeast corner of the Northeast Quarter of the Northeast Quarter of said Section 6, by
deed, in Book 115 of Deeds, on page 217 and by deed from William Dolan and Lydia Dolan, his wife, to
School District No. 120, dated November 15, 1933, Hennepin County, Minnesota, lying northerly of the
northerly right-of-way of HENNEPIN COUNTY HIGHWAY NO. 47 PLAT 13 and southerly of the following
described line and its easterly and westerly extension; and
WHEREAS, the Owners and City of Plymouth have agreed to grant the City permanent and
temporary easements over a portion of the properties located at 17910 Co Rd No 47, 17800 Co Rd No
47, and PID 0611822110001, 0611822110002, and 0611822120001 as stated within the Grant of
Permanent Easement documents (the “Easements”); and
WHEREAS, the City has agreed to pay the Owner $185,000.00 as compensation in full for their
granting of said permanent and temporary easements.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the payment of $185,000.00 to the Owners for the acquisition of Easements is hereby
approved upon Owners’ execution of said Easements and Memorandum of Understanding.
