HomeMy WebLinkAboutCity Council Resolution 2021-360 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-360 R ESOLUTION A PPROVING THE A CQUISITION OF R EAL P ROPERTY L OCATED AT 3525 K ILMER L ANE N ORTH AND D ISPENSING WITH S TATUTORY R EQUIREMENTS FOR R EVIEW BY P LANNING C OMMISSION OF C ONVEYANCE OF P ROPERTY WHEREAS, MSY Properties, LLC, owner of land identified by Property ID 24-118-22-11-0043, has accepted the City of Plymouth’s offer to purchase said land and improvements located at 3525 Kilmer Lane North in an amount of $1,800,000; and WHEREAS, the property is described as: Property ID 24-118-22-11-0043 at 3525 Kilmer Lane North in Plymouth, Minnesota. WHEREAS, the deed shall be created by Hennepin County; and WHEREAS, it is in the public interest to purchase this property to allow for the traffic and safety th improvements at Kilmer Lane North and 36 Avenue North; and WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the City's proposed acquisitions and dispositions of property, and WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning Commission review requirement upon 2/3 vote of the City Council dispensing with the requirement and finding that the acquisition or disposal of the property has no relationship to the comprehensive municipal plan. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the acquisition of the property has no relationship to the comprehensive municipal plan and review by the Planning Commission of the acquisition of the Property is hereby dispensed with and the purchase agreement in the amount of $1,800,000 plus associated legal and closing costs to successfully acquire said property is approved. APPROVED by the City Council on this 14th day of December, 2021.
