HomeMy WebLinkAboutCity Council Resolution 2021-246 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-246 R ESOLUTION A PPROVING A S ITE P LAN, V ARIANCE, AND C ONDITIONAL U SE P ERMIT FOR V ERIZON W IRELESS FOR P ROPERTY L OCATED AT 5725 J UNEAU L ANE (2021019) WHEREAS, Verizon Wireless, on behalf of the City of Plymouth has requested approval of a site plan, variance, and conditional use permit to allow construction of a new 130-foot cell tower with a 9-foot lightning rod and related site improvements at 5725 Juneau Lane legally described as follows: th The East 687 feet of that part of Lot 2, Section 4, Township 118 North, Range 22 West of the 5 Principal Meridian lying North of a line drawn East from a point in the West line of said Lot 2, distant 668.62 feet South of the Northwest corner thereof to a point in the East line of said Lot 2, distant 666.63 feet South of the Northeast corner thereof. Except the north 333.00 feet thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should approve the request by Verizon Wireless, on behalf of the City of Plymouth, for a site plan, variance, and conditional use permit to allow construction of a new 130-foot cell tower with a 9-foot lightning rod and related site improvements, subject to the following conditions: 1. A site plan, variance and conditional use permit is approved to allow construction of a130-foot cell tower with a 9-foot lightning rod and related site improvements, in accordance with the plans received by the City on March 22, 2021, with additional information on March 24, 2021, March 26, 2021, June 7, 2021, July 21, 2021, and July 22, 2021, except as amended by this resolution. 2. Approval of a signed lease agreement with the City of Plymouth. 3. Provide a signed lease which requires the applicant to remove the tower and associate facilities when they are abandoned, unused or become hazardous shall be submitted to the City. 4. Provide a letter of intent committing the tower owner and his or her successors to allow the shared use of the tower if an additional user agrees in writing to meet reasonable terms and conditions for shared use. 5. Provide a statement indicating whether battery backup power will be provided, and if so, the applicable Material Safety Data Sheets shall be provided. 6. The monopole shall be painted a non-contrasting color or have a galvanized finish. 7. A separate building permit is required prior to construction of the project. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable City code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain the required right-of-way permits from the City of Plymouth engineering division for any work in the Juneau Lane right-of-way. c. Obtain any required permits from other agencies including, but not limited to Minnesota Pollution Control Agency, as well as the NPDES permit. d. Obtain City approval of final construction plans. e. Prior to issuance of a building permit, the applicant shall submit documents prepared by a structural engineer demonstrating the tower can support an additional set of antennas. f. Obtain City Fire Department approval of final construction plans. g. Revise the plans to meet engineering requirements as follows: 1. Provide final engineering plans signed by a licensed engineer in the State of Minnesota in accordance with City plan submittal requirements. 2. All applicable City Standard Detail Plates to be included in plans. 3. Prior to commencement of grading operations, the applicant shall obtain a grading permit, and shall install and request inspection of silt/erosion control fencing. 4. Staff to approve Stormwater Pollution Prevention Plan (SWPPP). h. Revise the plans to meet fire code requirements as follows: 1. Fire lane construction per City Engineering details required for all development drives. 2. Identify existing hydrants on Juneau Lane. Hydrants - additional or relocation required in approved locations for the entire development. 3. Fire lane signs in approved locations required. 4. Site name/address signs required in approved locations. 5. Approved Turnarounds required at dead ends. 6. Approved bollards required at the transformer. The access drive and site drives shall be constructed to the minimum fire lane construction requirements. 7. Identify the contents and use of the equipment room. 8. Identify the fuel and quantity for the generator. A tank permit may be required. 9. All construction parking shall be located on-site. 10. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. The site shall remain in conformance with section 2025 of the City code regarding noise regulations. c. Compliance with the City’s lighting regulations. d. All signage shall require separate permits and shall be in conformance with the sign regulations in section 21155 of zoning ordinance. e. Compliance with City’s landscaping regulations. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. The site plan, variance and conditional use permit, shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under sections 21015.07, 21045.09 and 21030.06 respectively, of the zoning ordinance.
