A NGELA W OODWARD FOR P ROPERTY L OCATED AT 2605 F ERNBROOK L ANE (2021042) WHEREAS, Dr. Angela Woodward requested approval of a conditional use permit to allow a dog day/overnight boarding, indoor dog park, veterinary clinic with grooming, and accessory restaurant within an existing building for property legally described as Lot 3, Block 1, Scoville Business Park, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should approve the request by Dr. Angela Woodward for approval of a conditional use permit to allow a dog day/overnight boarding, indoor dog park, veterinary clinic with grooming, and accessory restaurant within an existing building located at 2605 Fernbrook Lane, subject to the following conditions: 1. A conditional use permit is approved to allow a 22,569 square foot dog day/overnight boarding facility, indoor dog park, veterinary clinic with grooming, and accessory restaurant, in accordance with the application and plans received by the City on June, 10, 2021, with additional documentation received by the City on June 29, 2021, July 2, 2021, July 22, 2021, and July 26, 2021, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. A separate building permit is required prior to the commencement of the project. 4. The permit is subject to all applicable noise, building, and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 5. Prior to issuance of a building permit, the applicant shall submit an approved kennel license consistent with the zoning ordinance and city codes. 6. Prior to occupancy of the building, the applicant must obtain separate approval of a building permit for the use of the building. 7. The applicant shall obtain any necessary liquor licenses prior to serving any beverages containing alcohol. 8. Kennel licenses must be kept current as required by City Code. Res. 2021-244 File 2021042 Page 2 9. No outdoor storage, grooming or retail sales are permitted with the conditional use permit. 10. The food and beverage area is allowed if only directly accessible from the principal use and shall not exceed 10 percent of the area. 11. The indoor dog park shall operate entirely within an enclosed buildings and shall not exceed five thousand square feet. 12. Standard conditions: a. Any signage shall require issuance of separate sign permits and comply with the City sign regulations. b. Any new proposed exterior lighting fixtures shall meet current zoning ordinance standards pursuant to section 21105.06. c. All waste and waste containers shall be stored within approved designated areas. d. All parking shall be off-street in designated parking spaces. e. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
