HomeMy WebLinkAboutCity Council Resolution 2021-242 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-242 R ESOLUTION A PPROVING V ARIANCE FOR S TUDIO 55 A RCHITECTS FOR P ROPERTY L OCATED AT 15100 S CHMIDT L AKE R OAD (2021054) WHEREAS, Studio 55 Architects has requested approval of a variance to allow construction of a 15-foot high outdoor shrine in the front yard area at Providence Academy, 15100 Schmidt Lake Road; and WHEREAS, the subject property is legally described as Lot 1, Block 1, Providence Academy, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Studio 55 Architects for a variance to allow construction of a 15-foot high outdoor shrine in the front yard area for property located at 15100 Schmidt Lake Road, subject to the following: 1. The requested variance is hereby approved, in accordance with the application and plans received by the City on July 9, 2021, except as may be amended by this resolution. 2. Any lighting related to the outdoor shrine must comply with the City’s lighting regulations. 3. The requested variance is approved, based on the finding that the applicable variance standards would be met as follows: a) The requested variance and its resulting construction would be in harmony with the general purposes and intent of the ordinance and would be consistent with the City’s comprehensive plan. b) The applicant has demonstrated that there are practical difficulties in complying with the ordinance regulations because the applicant proposes to use the property in a reasonable manner, and the variance would not alter the essential character of the property or neighborhood. The proposed shrine location would provide a quiet, safe area with easy access away from daily school activities. c) The requested variance is not based upon economic considerations. d) The variance and its resulting construction would not be detrimental to the public welfare, nor would it be injurious to other land or improvements in the neighborhood. The shrine area would be screened with vegetation and would be 360 feet away from the nearest home. Resolution 2021-242 (2021054) Page 2 e) The variance and its resulting construction would not impair an adequate supply of light and air to adjacent properties, nor would it increase traffic congestion or the danger of fire, endanger the public safety, or substantially diminish property values within the neighborhood. 4. Prior to commencement of the project, the applicant shall provide inlet protection to downstream catch basins and biologs to prevent soil erosion during construction. 5. Sidewalks and curb cuts related to the shrine must comply with Americans with Disabilities Act (ADA) regulations. 6. The variance shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the zoning ordinance.
