R ESOLUTION N O. 2021-241
R ESOLUTION A PPROVING THE R ELEASE OF AN E NCROACHMENT A GREEMENT L OCATED IN
L OT 2, B LOCK 1, RNL S UBDIVISION
WHEREAS, the City owns a drainage and utility easement over part of the property legally
described in Exhibit A attached hereto (“Subject Property”); and
WHEREAS, Hollydale Land, LLC is the fee owners of the Subject Property and is authorized to
encroach on the City’s drainage and utility easement with a garage structure pursuant to an encroachment
agreement entered into by the parties on October 24, 2006;
WHEREAS, the Hollydale Land, LLC has removed the existing garage structure and it has
determined that the encroachment no longer has value; and
WHEREAS, the City similarly desires to release the encroachment over its drainage and utility
easement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. The proposed release of encroachment agreement is approved, and the Mayor and City
Manager are authorized and directed to execute all documents and take all appropriate measures to
release the encroachment from the City’s drainage and utility easement.

Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City
