HomeMy WebLinkAboutCity Council Resolution 2021-161 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-161 R ESOLUTION A PPROVING V ARIANCE FOR T HOMAS AND E UNICE G OODRICH FOR P ROPERTY LOCATED AT 12311 S UNSET T RAIL (2021029) WHEREAS, Thomas and Eunice Goodrich have requested approval of a variance for a detached garage that would be located within the front yard area ; and WHEREAS, the subject property is legally described as the Westerly 10 feet of Lot 1, as measured along the front and rear lot lines thereof, and that part of Lot 2 lying Easterly of the Westerly 40 feet thereof, Block 4, Wilshire Gardens, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the request by Thomas and Eunice Goodrich for a variance to allow construction of a new detached garage in the front yard area for property located at 12311 Sunset Trail is approved subject to the following: 1. The requested variance to allow a detached garage within a front yard area is hereby approved, in accordance with the application and plans received by the City on April 22, 2021, except as may be amended by this resolution. 2. The variance allows an existing 240 square foot storage shed located in the rear yard to remain on the site. 3. The requested variance is approved, based on the finding that the applicable variance standards would be met, specifically: a) The requested variance and its resulting construction would be in harmony with the general purposes and intent of the ordinance and would be consistent with the City’s comprehensive plan. b) The applicants have demonstrated that there are practical difficulties in complying with the ordinance regulations, because: 1. The applicants propose to use the property in a reasonable manner. 2. The request is due to circumstances that were not created by the applicants. The existing one-car attached garage cannot be expanded due to minimum setback requirements to the east lot line, and the rear yard is inaccessible for vehicles due to a 12- foot drop in elevation and mature trees and foliage. The front yard is the most feasible location for additional garage space. 3. The variance would not alter the essential character of the lot or neighborhood. c) The requested variance is not based upon economic considerations. The applicants are requesting the variance in order to construct additional garage/storage space on the property. d) The variance and its resulting construction would not be detrimental to the public welfare, nor would it be injurious to other land or improvements in the neighborhood. The detached garage would be set back further from Sunset Trail than the existing home to the west. e) The variance and its resulting construction would not impair an adequate supply of light and air to adjacent properties, nor would it increase traffic congestion or the danger of fire, endanger the public safety, or substantially diminish property values within the neighborhood. The detached garage would comply with the minimum setbacks required for the home. f) The variance requested is the minimum action required to address the practical difficulties. 4. A building permit is required prior to commencement of the project. 5. Prior to issuance of the building permit, the applicants shall have the west side lot line located and marked by a certified surveyor. 6. The detached garage shall be side-loaded (overhead garage door(s) shall face east) and the materials, design, and height shall be compatible with the existing home. 7. The variance shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the zoning ordinance.
