RESOLUTION 2021-142
RESOLUTION DECLARING A FINDING OF “NO NEED” FOR AN ENVIRONMENTAL
IMPACT STATEMENT (EIS) RELATED TO THE ENVIRONMENTAL ASSESSMENT
WORKSHEET (EAW) FOR DUNDEE NURSERY REDEVELOPMENT (2020106)
WHEREAS, Minnesota Rules (4410.4300, Subp. 19. D) require preparation of an EAW for
multiple-family residential projects with 375 or more units; and
WHEREAS, the City of Plymouth is the responsible governmental unit (RGU) for the
EAW; and
WHEREAS, on March 15, 2021, an EAW was completed for Dundee Nursery
Redevelopment, which would consist of up to 300 residential units, up to 70,000 square feet for
a medical office building, and a 17,000 square foot existing church; and
WHEREAS, by March 17, 2021, the EAW was distributed to all persons and agencies on
the official Environmental Quality Board (EQB) distribution list and other interested parties; and
WHEREAS, on March 23, 2021, the EAW was publicly noticed in the EQB Monitor
commencing the 30-day public comment period; and
WHEREAS, public notice was submitted to the Sun Sailor newspaper announcing the
completion of the EAW, its availability to interested parties, and the process for submitting
comments on the EAW; and
WHEREAS, the 30-day comment period ended at 4:30 p.m. on April 22, 2021, and the
City of Plymouth accepted and responded to all written EAW comments that were received
within the comment period, and to all oral EAW comments that were received at the April 21,
2021 Planning Commission meeting; and
WHEREAS, the City Council has reviewed the EAW materials and has considered the
EAW comments made by agencies and other interested parties; and
WHEREAS, the City Council finds that the proposed project does not present a potential
for environmental impacts of such significance that an EIS would be required.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that:
1. The EAW was prepared in compliance with the procedures of the Minnesota
Environmental Policy Act and Minnesota Rules, Parts 4410.1000 to 4410.1700; and

2. The EAW and the Response to Comments made on the EAW satisfactorily address
the environmental issues; and
3. Based upon the criteria established in Minnesota Rules 4410.1700, the project does
not have the potential for significant environmental effects that that cannot be
mitigated and that are not reasonably expected to occur from the project; and
4. All mitigation measures or conditions of project approval identified in the EAW
materials, including but not limited to the Response to Comments, Findings of Fact,
and Record of Decision, shall be incorporated into any future development plans for
the site.
5. The city, acting as RGU, makes a “negative declaration” on the need for an EIS; and
6. The City adopts the Response to Comments, Findings of Fact, and Record of Decision
for the Dundee Nursery Redevelopment EAW, and the City Council directs city staff
to maintain the Record of Decision and distribute it in accordance with EQB rules.
