HomeMy WebLinkAboutCity Council Resolution 2021-126 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-126 R ESOLUTION A PPROVING S UBMISSION OF J OB C REATION/M INNESOTA I NVESTMENT F UND A PPLICATION IN C ONNECTION WITH S ILK M EDICAL I NC. WHEREAS, the City of Plymouth, Minnesota (the “City”), desires to assist Silk Road Medical, Inc, a medical device company, which is proposing to locate and expand in the City; and WHEREAS, in support of this endeavor, the City of Plymouth, is willing to act as the sponsor for the project; and WHEREAS, the City of Plymouth held a public hearing on April 13, 2021 to consider this matter. NOW, THEREFORE BE IT HEREBY RESOLVED that the City will act as the legal sponsor for the project contained in the Job Creation/Minnesota Investment Fund Application to be submitted on or about April 14, 2021 and that the Mayor and City Manager are hereby authorized to apply to the Department of Employment and Economic Development for funding of this project on behalf of Silk Road Medical, Inc. BE IT FURTHER RESOLVED that the City has legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to administer the proposed project. BE IT FURTHER RESOLVED that the City has not violated any Federal, State, or local laws pertaining to fraud, bribery, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the State, the City may enter into a Grant Contract with the State of Minnesota for the approved project, and that the City certifies that it will comply with all applicable laws, statutes, regulations and rules as stated in the Grant Contract and described in the Project Compliance Certification of the Application. BE IT FURTHER RESOLVED that the City has obtained credit reports and credit information on Silk Road Medical, Inc. Upon Review by the City, no adverse findings or concerns regarding, but not limited to, tax liens, judgements, court actions, and filings with state, federal and other regulatory agencies were identified. Failure to disclose any such adverse information could result in revocation or other legal action. Resolution No. 2021-126 Page 2 of 2 BE IT FURTHER RESOLVED that the Mayor and City Manager, or their successors in office, are authorized to execute the Grant Contract and amendments, thereto, as are necessary to implement the project on behalf of the City.
