HomeMy WebLinkAboutCity Council Resolution 2021-110 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-110 R ESOLUTION A PPROVING S ITE P LAN A MENDMENT AND C ONDITIONAL U SE P ERMIT FOR P ROPERTY LOCATED AT 815 H IGHWAY 169 (2021004) WHEREAS, Kimley-Horn & Associates have requested approval of a site plan amendment and conditional use permit to allow a dog day/overnight boarding facility and related site improvements within an existing building for property legally described as Lots 21 and 22, except the East 167 feet thereof, Plymouth Gardens, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Kimley-Horn & Associates for a site plan amendment and conditional use permit to allow a dog day/overnight boarding facility and related site improvements located at 815 Highway 169, subject to the following conditions: 1. A conditional use permit is approved to allow a 15,079 square foot dog day/overnight boarding facility, in accordance with the application and plans received by the City on January 19, 2021, with additional documentation received by the City on February 8, 2021, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. A separate building permit is required prior to the commencement of the project. 4. If the City determines that there is a parking shortage on the site at any point in the future, the business owner shall stripe up to 14 additional parking spaces (as determined by the City) on the site, or reduce the number of boarding rooms/kennels. 5. The permit is subject to all applicable noise, building, and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 6. Prior to occupancy of the building, the applicant must obtain separate approval of a building permit for the use of the building and installation of an eight-foot fence. 7. Prior to issuance of a building permit, the applicant shall submit the following consistent with the zoning ordinance and city codes: a. An approved kennel license. Res. 2021-110 File 2021004 Page 2 b. Receive city approval of final construction plans. c. Receive any required Fire Department approval. d. Obtain any necessary Bassett Creek Watershed permits. e. Show erosion and sediment controls, i.e. silt fence, bio-logs, and inlet protections to downstream drains. f. The applicant shall submit the required financial guarantees and site improvement performance agreement (SIPA) prior to issuance of permits. 8. Revise the plans to meet fire requirements as follows: a. Identify the fire department connection, and post indicator valve location. b. Submit fire flow calculations. c. Fire lane construction per City Engineering details required. d. Hydrants - additional or relocation required in approved locations. e. An approved solenoid valve is required on the combined fire/domestic water supply line to the building. f. Identify the fuel supply for the generator. g. The entire building shall be protected by an approved fire sprinkler system. h. Fire lane signage shall be provided in locations as approved and field identified by the fire inspector. i. A hydrant is required in an approved location at the southwest site entry drive location and within 50 feet of the fire department connection. 9. Kennel licenses must be kept current as required by City Code. 10. No outdoor storage, grooming or retail sales are permitted with the conditional use permit. 11. Standard conditions: a. Any signage shall require issuance of separate sign permits and comply with the City sign regulations. b. All retaining walls over four feet shall require issuance of a building permit and a 42- inch fence installed on top of the wall. c. Any new proposed exterior lighting fixtures shall meet current zoning ordinance standards pursuant to section 21105.06. d. All waste and waste containers shall be stored within approved designated areas. e. All parking shall be off-street in designated parking spaces. f. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
