R ESOLUTION N O. 2021-109
R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT FOR F ENCE AND T WO S WING
G ATES ON P ROPERTY LOCATED AT 18905 41 ST A VENUE N ORTH
WHEREAS, Sadiyo Gudle Mohamed, property owner, has requested the City of Plymouth to
approve an encroachment agreement allowing a fence and two swing gates within drainage and utility
easements at 18905 41st Avenue North; and
WHEREAS, the owner’s property is legally described as:
Lot 1, Block 3, Summers Edge South
WHEREAS, the encroachment agreement permits only the fence and two swing gates within the
easements and all related facilities must still meet all applicable City codes; and
WHEREAS, as stated in the encroachment agreement, if the City requests that the structures
need to be removed in the future, it will be at the property owner’s expense; and
WHEREAS, as stated in the encroachment agreement, the property owner grants the City a
limited right of entry onto that portion of the east and southeast side of the property for maintaining,
replacing, cleaning, inspecting, and conducting other public purpose related to the rights under the
City’s easement(s).
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the encroachment agreement allowing a fence and two swing gates within drainage
and utility easements located at 18905 41st Avenue North is approved.
