HomeMy WebLinkAboutCity Council Resolution 2021-078 C ITY OF P LYMOUTH R ESOLUTION N O. 2021-078 R ESOLUTION A PPROVING S TORM W ATER A GREEMENT AND E NCROACHMENT A GREEMENT FOR THE P LYMOUTH E LEMENT A PARTMENT P ROJECT AT 11229 S TATE H IGHWAY 55 WHEREAS, Plymouth Element, LLC, received administrative approval of a PUD Final Plan at 11229 State Highway 55; and WHEREAS, the property is legally described as: Lot 1 Block 1, Crossroads Commons Second Addition; and WHEREAS, a storm water agreement is required for the storm water filtration basins and sump storm manholes; and WHEREAS, the storm water agreement requires the property owner to perform maintenance on the filtration basins and sump storm manholes; and WHEREAS, parking lot, parking lot lights, sidewalk and retaining wall were approved to be constructed within drainage and utility easements in the project per the development construction plans; and WHEREAS, the City requires an encroachment agreement to allow encroachments within drainage and utility easements; and WHEREAS, the encroachment agreement permits only the parking lot, parking lot lights, sidewalk and retaining wall within the easements and all related facilities must still meet all applicable City codes. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the storm water agreement and the encroachment agreement for the Plymouth Element apartment project at 11229 State Highway 55 are approved. APPROVED by the City Council on this 9th day of March, 2021.
