Councilmembers Ho_yt, Neils, Shcneider and Threinen The following members were absent: none Councilmember Neils introduced the fo'Ilowinq Resolution and moved its adoption: RESOLUTION NO. 80-926 REQUEST FOR PAYMENT NO. 5 AND FINAL RAPPAPORT ADDN. UTILITIES PROJECT NO. 846 WHEREAS, the City of Plymouth as Owner and Northdale Construction Company as Contractor have entered into an agreement for the improvement of Rappaport Addition utilities, said Agreement being dated August 13, 1979. WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the original contract amount was $269,388.00, one charge order was approved in the amoutn of $10,635.00, and the value of the work completed and certified to date is $272,589.24. 2. That the work performed by the Contractor for Project No. 846 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Corrections of Faulty Work after Final Payment. Request for Payment No. 5 and Final in the amount of $12,248.08 to Northdale Construction Company for Project No. 846 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Coag ilmember Ho t , and upon vote being taken thereon, the following voted in favor t ereo : �Rayor Davenport.
