The following members were present: Mayor Davenport, Councilmembers Hoy, Neils, Schneider and Threinen The followirg members were absent: none Cou�- Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-925 REQUEST FOR PAYMENT NO. 4 AND FINAL SHEDD BROWN/SCHIEBE ADDITION/FABER PLACE UTILITIES PROJECT NO. 916, 943 & 013 WHEREAS, the City of Plymouth as Owner and A. C. G. Mechanical as Contractor have entered into an agreement for the improvement of Shedd Brown/Schiebe/Faber Place Utilities, said Agreement being dated July 7, 1980. WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $223,693.20, two change orders were approved is the amount of $14,917.00, and the value of the work completed and certified to date is $247,724.46. 2. That the work performed by the Contractor for Project No. 916, 943 & 013 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Corrections of Faulty Work after final payment. 3. Request for Payment No. 4 and Final in the amount of $42,711.88 to A. C. G. Mechanical for Project No.916,943 & 013 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by M or Davenrort , and upon vote being taken thereon, the following votedin favor thereof: Mavor Davenport, Councilmembers Hoyt, Neils. Schneider and Threinen The following voted against or abstained: none Whereupon the Rerolution was declared duly passe---and`a-Copte
