The following members were present: .ayor unt, Counci mem ers Hoy—t—,-Neils and Schneider The following members were a sent: ounce I member Davenport WuprilmPmber Neils introduced the following Resolution and moved is a option: RESOLUTION NO. 80-831 APPROVING SITE PLAN FOR VOLP CONSTRUCTION COMPANY SOUTH OF TESCOM PROPERTY ON THE EAST SIDE OF NIAGARA LANE NORTH OF 23RD AVENUE NORTH (80058) WHEREAS, Volp Construction Company has requested approval of a site plan for a 7,200 square foot office/warehouse complex to be located south of Tescom property on the east side of Niagara Lane north of 23rd Avenue North; and, WHEREAS, the Planning Commission has reviewed said request and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Volp Construction Company for site plan approval of a 7,200 square foot office/warehouse complex to be located south of Tescom property on the east side of Niagara Lane north of 23rd Avenue North subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees in lieu of dedication in an amount determined according to the verified acreage and according to the dedication policy in effect at the time of building permit issuance. 3. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 4. Location of fire hydrants and fire ,anes per City Code. 5. Compliance with the ordinance regarding curbing and drainage requirements for the site including specifications as to driving and parking areas. 6. Submission of required financial guarantee for completion of the required site improvements termed for 24 months. 7. Any signage shall be in compliance with the ordinance. 8. Provision for a 25 foot wide trail easement per the City's Corridor Use Plan verified by the Parks and Engineering Departments along the north side of the property, with submittal of detailed plans as to construction of the trail per City standards. Resolution N 80-831 Page 2 9. Approval is for the initial phase only; any future expansion shall be subject to ordinance plan approval requirements and standards. 10. The plans shall be amended to relocate the building a minimum of 25 feet further to the east to comply with ordinance minimum setback requirements. 11. Landscape plan shall be amended to provide a minimum of 11 additional over - story trees to comply with the landscape criteria; all plantings shall be installed with the initial phase; at least 5 of the plantings shall be ever- green trees and shall be appropriately located at the west end of the parking lot entrance so to provide ordinance required screening of the parking and driving areas. 71* notion for tine adoption of the foregoing Resolution was duly seconded and upon vote being taken thereaa, the fol VC in rMr tee Mayor Hunt.
