Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 17th day of
November , 19 80 • The following members were present: Mayor Hunt,
Councilmembers Davenport, Hoyt, Neils and Schneider
were
introduced the following Resoluticn and moved
its adoption:
RESOLUTION NO. 80-826
AUTHORIZING THE VACATION OF A PORTION OF LOT 2, BLOCK 1, METRO INDUSTRIAL PARK
AND A PORTION OF 28TH AVENUE NORTH
WHEREAS, a petition was received to vacate a portion of Lot 2, Block 1, Metro
Industrial Park and a portion of 28th Avenue North; and
WHEREAS, a public hearing with respect to said vacation was held on November 17,
1980 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of November 17, 1980; and
WHEREAS, the Council did hold a public hearing on November 17, 1980 to inform any
and all interested parties relevant to the vacation of a portion of Lot 2, Block 1,
Metro Industrial Park and a portion of 28th Avenue North; and
WHEREAS. it was determined by the City Council that a certain portion of Lot 2,
Block 1, Metro Industrial Park and a portion of 28th Avenue North is not needed for
a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of got 2, Block 1, Metro Industrial Park and 28th
Avenue North be vacated as a public roadway:
Commencing at the Northeast corner of Lot 1, Block 2, METRO INDUSTRIAL PARK;
thence South 0 degrees 41 minutes 18 seconds West, assumed bearing, along
the East line of said Lot 1 a distance of 5.00 feet; thence North 89 degrees
40 minutes 23 seconds West to the intersection with the Northerly line of
said Lot 1, said point being the point of beginning of the tract of land to
be described; thence continuing North 89 deorees 40 minutes 23 seconds West,
a distance of 110.50 feet; thence Northwesterly, along a tangential curve
to the right having a radius of 540.00 feet, a distance of 63.82 feet; thence
Southwesterly, along a non-tangential curve concave to the Northwest to a
point in the Northerly line of said Lot 1, Block 2, METRO INDUSTRIAL PARK
distant 506.32 feet Westerly, as measured along said Northerly line, from the
Northeast corner of said Lot 1; thence Easterly, along said Northerly line
of Lot 1, to the point of beginning.

2. That said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants and natural drainage
areas thereon or thereunder, to Continue maintaining the same or to enter
upon such way or portion thereof vacated to repair, replace, remove or other-
wise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by ouncilmember Davenport , and upon vote being taken thereon, the

Whereupon the Resolution was declared duly-PasseT a t
