Pursuant to due call and notice thereof, arpgdar meeting of
the City Council of the City of Plymouth, Minnesota was he7d on the
17th day of November , 19 80. The following members were
present: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider
The following members were absent: none
Wipclmember Neils introduced the following Resolution and
move its adoption:
RESOLUTION NO. 80-825
AUTHORIZING THE VACATION OF A PORTION OF
AN EASEMENT ON LOT 7, BLOCK 1, FAZENDIN-KROGNESS ADDITION
WHEREAS, a petition was received to vacate a portion of an easement on Lot 7, Block 1,
Fazendin-Krogness Addition;/and
WHEREAS, a public hearing with respect to said vacation was held on November 17,
1980 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of November 17, 1980; and
WHEREAS, the Council did hold a pubiic hearing on November 17, 1980 to inform any
and all interested parties relevant to the vacation of a portion of do easement
on Lot 7, Block 1, Fazendin-Krogness Addition; and
WHEREAS, it was determined by the City Council that a certain portion of an easement
on Lot 7, Block 1, Fazendin-Krogness Addition is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of an easement on Lot 7, Block 1, Fazendin-Krogness
Addition be vacated as a public roadway:
The south 185.4 feet of the west 30 feet of Lot 7, Block 1, Fazendin-Krogness
Addition.
2. That said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants and natural drainage
areas thereon or thereunder, to continue maintaining the same or to enter upon
such way or portion thereof vacated to repair, replace, remove or otherwise
attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt , and upon vote being taken thereon
following voted in avor ereo : Mayor Hunt, Councilmembers Hoyt, Mei s
and Schneider
The following voted against orabstained: Councilmember Davenport
Whereupon the Resolution was declared duly passed and adopted.
