Pursuant to due call and notice thereof, a _ regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 3rd day of
10 November. 1980 . The following members were present: Mayor Hunt,
}mpmhprs nay nnort- Neils and Schneider
The ro owing members were absent: Councilmember Hoyt
Councilmember ,Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 80-814
AUTHORIZING REDUCTION OF SITE PERFORMANCE GUARANTEE FOR HAPPY CHEF RESTAURANT
(A-830)
WHEREAS, the site plan submitted for the Happy Chef Restaurant, located at 14370 -
28th Place, was approved under City Council Resolution No, 78-461; and,
WHEREAS, the developer submitted the required site performance guarantee in the
form of a Letter of Credit in the amount of $32,000, subsequently reduced to
$5,000; and,
WHEREAS, upon the request of the developer for site inspection and release or
reduction of the financial guarantee, City Staff has inspected said site and
recommends reduction of the performance guarantee;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does authorize the reduction of the site
performance guarantee, Security State Bank of Mankato Letter of Credit in the
amount of $5,000 which was submitted to guarantee site improvements for the Happy
Chef Restaurant located at 14370 - 28th Place,to $1,000.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmpmhpr Ngtlg , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Hunt. Councilmembers Davpnpnrt. Npils
and Schneider
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
