Pursuant to tue call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 6th day of

RESOLUTION NO. 80-749
DENYING SUBDIVISION VARIANCE TO PERMIT A LOT DIVISION FOR PHOENIX MUTUAL LIFE
INSURANCE COMPANY AT 3020 HARBOR LANE (A-441)
WHEREAS, Phoenix Mutual Life Insurance Company has requested approval of a
subdivision variance to allow a lot division to create a new legal parcel of
.548 acres containing the recreation building and attached railroad car located
at 3020 Harbor Lane; and,
WHEREAS, the Planning Commission has reviewed said request and has recommended
denial;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does deny the request of Phoenix Mutual Life
Insurance Company for a subdivision variance to allow a lot division to create a
new legal parcel of .548 acres containing the recreation building and attached
railroad car for the following reasons:
1. The proposed parcel is substandard and contains uses specifically proposed and
approved as accessory amenities to the overall development and not as free-
standing independent land uses.
2. The Ordinance variance criteria are not clearly satisfied considering that the
alleged hardship and uniqueness are not attributable to Ordinance requirements
but rather to private and unauthorized actions by the parties involved.
3. There are legal solutions to the problem other than an inappropriate exercise
of land use regulations.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Hunt, Councilmembers Davenport,
Hovt, Neils and Schneider
