The following members were present• it, Councilmembers ng members were a enport, Hoyt, Neils and Schneider cnilpcilmemb_er Dave ^ort introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-742 ADOPTING ASSESSMENTS PROJECT 611 - 807 - 853 - 911 DOWNTOWN PLYMOUTH AREA AND VICKSBURG LANE FROM STATE HIGHWAY 55 TO OLD COUNTY ROAD 9 - PLYMOUTH HILLS ADDITION WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the following improvement: Vicksburg Lane from State Highway No. 55 to Old County Road 9, Old County Road 9 from Vicksburg Lane to ins intersection with New County Road 9, New County Road 9 from Vicksburg Lane to Old County Road 9, Plymouth Boulevard from New County Road 9 to State Highway No. 55, 37th Avenue from Vicksburg Lane east to its terminus, 36th Avenue from Vicksburg Lane to Plymouth Boulevard, 35th Avenue from Plymouth Boulevard west to its terminus, 34th Avenue from 35th Avenue to Plymouth Boulevard, 34th Avenue from Plymouth Boulevard northeasterly to its terminus, 32nd Avenue from Plymouth Boule- vard to Cavanaugh's 4th Addition, sanitary sewer trunk line from 34th Avenue north to Fernbrook Lane by the installation of watermain laterals and trunk facilities, sanitary sewer laterals and trunk facilities, bitumi- nous street with concrete curb and gutter, storm sewer, pedestrian underpass and all necessary appurtenances. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: as amended 1. Such proposed assessment,/a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assess- ment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the installments to be payable on or before the first Monday in January, 1981, and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1981. To each subsequent installment when due shall be added interest for one year on all unpaid installments. J Resolution N 80_742 Page 2 3. The owner of any property so assessed „gay, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assess- ment on such property with interest accrued to the date of payment to the City Finance Director, except that no interest shall be charged if the entire assess- ment is paid within 30 days from the adoption of this Resolution; and he may at any time thereafter pay the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this Resolution is: Water Lateral $ 507,792.69 Sanitary Sewer 224,711.25 Storm Sewer 599,721.72 Street 2,527,535.95 Water Area 267,211.25 Sanitary Sewer Area 58,113.00 Total Cost $4,185,085.86 Less Developer Down Payment 515,514.00 Balance Assessed $3,669,571.86 6.
