Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth, Minnesota was held on the
29th day of September , 1980 . The following members were
present: Acting Mayor Davenport,ouncilmem-Fiers Hoyt, Neils and Schneider
The following members were absent: Mayor Hunt
Councilmember Hoyt introduced the following Resolution and
mo ev d its d option:
RESOLUTION NO. 80- 738C
REQUEST FOR PAYMENT NO. 6 AND FINAL
NORTHWEST INTERCEPTOR SEWER
PROJECT NO. 902
WHEREAS, the City of Plymouth as Owner and Northdale Construction co. as Contractor
have entered into an agreement for the improvement of Northwest Interceptor Sewer,
said Agreement being dated February 20, 1979; and
WHEREAS, tr.. Engineer has certified his acceptance of the work and his approval of
the Final Request for Payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $336,612.00, one change order
was approved in the amount of $43,648.90, and the value of the work
completed and certified to date is $393,355.10.
2. That the work performed by the Contractor for Project No. 902 and
certified to the Council by the Engineer as acceptable be and the
same is hereby released from the contract except as to the conditions
of the Performance Bond, any and all legai rights of the Owner,
required guarantees and Corrections of Faulty Work after Final Payment.
3. Request for Payment No. 6 and Final in the amount of $29,050.72 to
Northdale Construction Co. for Project No. 902 is hereby approved and
the City Finance Director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Davenport, Councilmembers Hoyt,
Neils and (Schneider
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
