Pursuant to due call and notice thereof, a special meetina of
the City Council of the City of Plymouth, Minnesota was held on the
29th day of September , 1980 . The following members were
present: acting rt. Councilmembe s Hoyt. Neils
The following members were absent: Mavar Hunt
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 80- 7388
REQUEST FOR PAYMENT NO. 8 AND FINAL
LOST LAKE AREA AND OAKVIEW LANE WATERMAIN
PROJECT NO. 811 & 813
WHEREAS, the City of Plymouth as Owner and Nodland Associates, Inc. as Contractor
have entered into an agreement for the improvement of Lost Lake Area and Oakview
Lane Watermain, said Agreement being dated July 13, 1978; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of
the Final Request for Payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $277,885.50, two change
orders were approved in the amount of $18,299.00, and the value
of the work completed and certified to date is $276,758.87.
2. That the work performed by the Contractor for Project No. 811 and
813 certified to the Council by the Engineer as acceptable be and
the same is hereby released from the contract except as to the
conditions of the Performance Bond, any and all legal rights of the
Owner, required guarantees and Corrections of Faulty Work after
Final Payment.
3. Request for Payment No. 8 and Final in the amount of $10,402.77 to
Nodland Associates, Inc. for Project No. 811 and 813 is hereby
approved and the City Finance Director is hereby authorized and
directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils and upon vote being taken thereon, the
following voted in favor ereo : Acting Mayor Davenport, Councilmembers
Hut, Neils and Schneider
The following voted against or abstained: bone
Whereupon the Resolution was declared duly passe an adopte .
