HomeMy WebLinkAboutCity Council Resolution 1980-738ACITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meetino_ of the City Council of the City of Plymouth, Minnesota was held on the 29th day of September , 1980 . The following members were present: Actinq Mayor Daven ort, Councilmembers Hoyt, Neils and Schneider The following mem ers we e absent: Mayor Hunt Councilmember Hoyt _ introduced the following Resolution and movedits adoption: RESOLUTION NO. 80- 738A REQUEST FOR PAYMENT NO. 7 AND FINAL PUBLIC UTILITIES BUILDING EXPANSION PROJECT NO. 808 WHEREAS, the City of Plymouth as Owner and Lowry Hill Enterprises as Contractor have entered into an agreement for the improvement of the Public Utilities Build- ing, said Agreement being dated September 4,1979; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $506,918.00, one change order was approved in the amount of $4,211.59, and the value of the work completed and certified to date is $511,129.59. 2. That the work performed by the Contractor for Project No. 808 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Corrections of Faulty Work after Final Payment. 3. Request for Payment No. 7 and Final in the amount of $34,439.54 to Lowry Hill Enterprises for Project No. 808 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the 0 owing voted in avor ereo : Acting Mayor Davenport, Councilmembers Hyo +t, Neils and Schneider The fo owing voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
