Pursuant to due call and notice thereof, a Special meeting of the City
Council of the City of Plymouth. Minnesota, was held on the 29th day of

AMENDING COUNCIL RESOLUTION NO. 80-605 RELATIVE TO PRELIMINARY•PLAT AND CONDITIONAL
USE PERMIT FOR JOHN SPAETH FOR "LILLIE POND" MPUD 80-1 LOCATED SOUTH OF HIGHWAY 55,
EASTERLY OF DUNKIRK LANE AND NORTH OF 31ST AVENUE NORTH (80006)
WHEREAS, The City Council on September 2, 1980 approved Resolution No. 80-605
approving a preliminary plat and conditional use permit for John Spaeth for
"Lillie Pond" MPUD 80-1 consisting of 3 industrial lots and 49 dwelling units
on 41.16 acres; and,
WHEREAS, item #8 of that Resolution provided that the final density is exclusive of
acreage designated as ponding subject to final verification based upon approved
permits for land reclamation and filling; and,
WHEREAS, item #2 of said resolution provided that the attached dwellings shall be
distributed throughout the development for a more creative design effect; and.
WHEREAS, the City has received revised accurate topographical information from the
City's Consulting Engineer relative to this development; and,
WHEREAS, the petitioner has requested approval of a revision to allow dwelling
units based on a possible exchange of land with the adjacent church property prior
to final platting;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve amendments to Resolution No.
80-605 to read as follows:
1. Compliance with the City Engineer's Memorandum.
2. Completion of the required environmental assessment worksheet process prior
to final platting.
3. Compliance with the City Park Dedication Policy in effect at the time of
filing of the final plat relative to provision for trail corridor improve-
ments and relative to payment of fees.
4. Written approval from the Departiment of Natural Resources for proposed
alterations and filling of established wetlands.

5. Final alignment of New Medina Road to be reviewed and verified by the City
Engineer.
6. Designation of industrial area north of Medina Road as an outlot.
7. Incorporation of designated ponding area as an outlot by means of a covenant
with the homeowners association.
8. Approved density ratio of 2.2 units per acre for LA -1 and 3.4 units per acre
for LA -2 based upon an assignment of 2 bonus points; the total number of
dwelling units shall not exceed 45 consisting of 15 single family detached
dwellings and 15 two family dwellings. Final density is exclusive of the
13.89 acres that are below the established high water elevation of 995.5.
9. Black Oaks Lane shall not intersect at Medina Road, but shall end in a cul-
de-sac at the north end.
10. Elimination of Lot 6, Block 3 with the area incorporated into the remaining
lots in Block 3.
11. Lots for all duplex units shall be reduced to the building size to permit
more common open space area, in addition to the ponding area.
12. The approved number of units is subject to an acceptable final design based
upon possible land exchange with the adjacent church property and upon final
site plan approval.
13. Zoning of the property for Planned Unit Development shall be finalized with
the final plat per Section 9 of the Zoning Ordinance.
14. Minimum lot size on final plats for lots abutting Mapledell shall be 15,500
square feet.
15. Developer shall submit cross-section maps showing buffering of attached units
on Dunkirk Lane with the final plat.
16. Buffering or berming shall be required south of Medina Road for those lots
abutting.
