The following members were present: Mayor Hunt. Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 80 -698 ADOPTING ASSESSMENTS PROJECT 905 - FERNBROOK LANE IMPROVEMENT - HIGHWAY 55 TO COUNTY ROAD 6 WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the following improvement: Fernbrook Larva from CSAR 6 to T.H. 55, the extension of Cheshire Lane southerly to 25th Avenue and improvement to an urban cross-section of the existing Cheshire Lane south of T.H. 55 by the installation of a 9 - ton bituminous street with concrete curb and gutter and including full grading, gravel base, bituminous surface, all necessary drainage facilities, sanitary sewer, watermain and all appurtenances. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: as amended, I. Such proposed assessment,/a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assess- ment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years. the first of the installments to be payable on or before the first Monday in January. 1981, *nd shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution.. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1981. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of payment, to the City Finance Director, except that no interest shall be charged if the entire assessment is`paid within 30 days from the adoption of this Resolution, and he may at a;W time there- after,, pay the City Finance Director,,, the- entire amount of the assessment remaining unpaid.,with interest accrued to December 31, of the year'in whl such payment; is made. Pl?tion 80-698 s 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this Resolution is: Watermain $ 58,141.32 Streets 650,328.49 Water Area 31,435.50 $739,905.31 6. The total cost to be financed by the City is: # Water Trunk Fund $30,129.65 MSA 63,287.04 $93,416.69
