Councilmember Schneider introduced the following Resolution and moved its

RESOLUTION NO. 80 - 692
ADOPTING ASSESSMENTS
PROJECT 804 - FERNBROOK LANE - HARBOR LANE TO COUNTY ROAD 9
CEDAR RIDGE ADDITION, FOX GLEN ADDITION, CRITERION M.P.U.D. ADDITION
WHEREAS, pursuant to proper notice duly given as required by law, the Council has
met and heard and passed upon all objections to the proposed assessments for the
following improvement:
Fernbrook Lane from CSAH 9 to approximately 416 ft. north of Harbor Lane,
40th Avenue east of Fernbrook Lane, 35th Avenue east of Fernbrook Lane, the
area north of CSAH 9 from approximately Glacier Lane to I-494 tributory to
the Fernbrook Lane sewer (Sewer District, NW -7) according to plan of the
report supplement of the comprehensive sewer report of Plymouth, Minnesota,
1973, and Glacier Lane north of CSAH 9 by the installation of sanitary sewer
lateral and trunk facilities, watermain lateral and trunk facilities,
bituminous street construction (9 -ton design on Fernbrook Lane and 7 -ton
design on residential streets) with concrete curb and gutter, storm drainage
facilities, bridge replacement on Fernbrook Lane at Plymouth Creek, sanitary
sewer trunk and laterals to serve the existing and proposed plats on the east
and west sides of Fernbrook Lary- south of CSAH 9.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THL CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:

1. Such proposed assessment,/a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against
the lands named therein and each tract of land therein included is hereby
found to be benefitted by the proposed improvement in the amount of the assess-
ment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of 5 years, the first of the installments to be payable on or before
the first Monday in January, 1981, and shall bear interest at the rate of 8% per
annum from the date of the adoption of this asse*sment resolution. To the first
installment shall be added interest on the entire assessment from the date of
this Resolution until December 31, 1981. To each subsequent installment when due
shall be added in+erest for one year on all unpaid installments.

3. The owner of any property so assessed may, at any time prior to certification of
the assessment to the County Finance Director, pay the whole of the assessment
on such property with interest accrued to the date of payment, to the City Finance
Director, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this Resolution; and he may at any time there-
after, pay the City Finance Director, the entire amount of the assessment
remaining unpaid, with interest accrued to December 31, of the year in which such
payment is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment to
the County Finance Director to be extended on the proper tax lists of the County
and such assessments shall be collected and paid over in the same manner as other
municipal taxes.
5. The total cost of the improvement assessed by this Resolution is:
