Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was die on t e 22nd day of
September , 19 80 . The following members were present: ayor unt,

Councilmember Neils introduced the following Resolution and moved
is adoption:
RESOLUTION NO, 80- 688
APPROVING CONDITIONAL USE PERMIT FOR JERRY'S MINNEAPOLIS TIRE CD,, INC, FOR A
TIRE REPAIR AND RETAIL TIRE SALES OPERATION LOCATED AT 11318 HIGHWAY 55 (80049)
WHEREAS, Gerald A. Chubb has requested approval of a conditional use permit for
Jerry's Minneapolis Tire Co., Inc. for a tire repair and retail tire sales opera-
tion located at 11318 Highway 55; and,
WHEREAS, the Planning Commission has reviewed said request and recommended
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request of Gerald A. Chubb
for a conditional use permit for Jerry's Minneapolis Tire Co., Inc. for a tire
repair and retail tire sales operation located at 11318 Highway 55 subject to the
following conditions:
1. The conditional use permit is subject to all applicable codes, ordinances and
regulations and violation thereof shall be grounds for revocation. Approval
shall be subject to plan approval by the Building Official as to the proposed
occupancy and appropriate Code requirements..
2. The conditional permit is issued to the petitioner and is not transferable.
3. Vehi-,ular access through the overhead door at the west end of the building
shall be effectively prevented by an appropriate barrier as approved by the
Building Official and the west yard area shall be improved with sodding and
plantings and the existing curbing extending from the building shall be
removed.
4. Parking of vehicles other than in the designated parking lot shall be
prohibited.
5. The paved portion of the front yard area Shall be restored to a landscaped
condition to include proper fill, dirt and sodding;' the south edge of the
yard adjacent to the road easement shall bo curbed -as approved by the City
Engineer.

6. Existing signage for previous uses shall be removed and new signage shall be
in conformance with the City Ordinance. T-
7. There shall be no outside storage, display or sales of merchandise or related
materials.
8. All waste and waste containers shall be stored within the building or within
an approved enclosure as allowed by the City Zoning Ordinance.
9. Revised site plan detailing landscape improvements as directed shall be
submitted along with the ordinance required site performance guarantee
termed for 24 months.
