Mayor Hunt introduced the following Resolution and moved

RESOLUTION NO. 80-684
APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR FRANK LARSON/GAR-LAR
PROPERTIES FOR "PLYMOUTH HILLS ESTATES" RPUD AT THE SOUTHWEST CORNER OF COUNTY
ROAD 9 AND VICKSBURG LANE (80013)
WHEREAS, Frank Larson/Gar-Lar Properties has requested approval of a preliminary
plat and conditional use permit for "Plymouth Hills Estates" RPUD for 22 duplexes
(44 units) and 11 quadriminiums (44 units) for a total of 88 units on 26.8 acres
located at the southwest corner of County Road 9 and Vicksburg Lane; and,
WHEREAS, the Planning Commission has considered the request following a duly
called public hearing and has recommended approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request for Frank Larson/
Gar -Lar Properties for preliminary plat and conditional use permit for "Plymouth
Hills Estates" RPUD for 88 duplex and quadriminium units on 26.8 acres located
at the southwest corner of County Road 9 and Vicksburg Lane subject to the
following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Utility improvements, in accordance with the City's Comprehensive Sewer and
Water Plans, must be extended by private development and not by public
improvement.
3. Final alignment and design of public *rails shall be in accordance with City
plan and reviewed by the City Parks and Engineering Departments; detailed
plans as to location and construction shall be submitted with the final plat
and plan. Crossing of Vicksburg Lane will be addressed.
4. Compliance with the provisions of Section 6 of the Zoning Ordinance relative
to subdivision and development in the General Flood Plain District prior to
final platting.
5. Completion of Environmental Assessment Worksheet process prior to final
platting.
6. Written approval by the Department of Natural Resources as to the alteration
of designated wetlands on this site prior to final platting.

7. Submittal of a revised concept plan to include the Stivland property to the
southeast showing ultimate possible access to the total parcel from other
than Vicksburg Lane, that access shall be provided via Xene Lane future extension.
8. Revision of the preliminary site plan and preliminary plat to exclude the
Stivland property.
9. Approved density ratio of 3.4 units per acre for LA -2 based upon an assignment
of 2 bonus points; the total number of dwelling units to be 88 consisting of
11 quadriminiums and 22 duplex units with 0 single family. Final density is
exclusive of that land determined by the City Engineer to be at or below the
high water elevation per the City's adopted Storm Water Drainage Plan.
10. There shall be no private driveway access to 41st Avenue North easterly of
proposed Weston Lane.
11. Final site plans shall include a detailed landscape plan including analysis
of existing vegetation to be used as part of the landscaping treatment.
12. Lot 9, Block 4 shall be incorporated into Outlot A and Lot 6, Block 5 shall
be incorporated into Outlot B, Lot 9, Block 3 shall be incorporated into
Outlot A and Lot 4, Block 2 shall be incorporated into Outlot 8, subject to
final determination as to what, if any, land is to be dedicated for trail
corridor purposes.
13. Requiring that setback of structures from the west plat boundary be
arranged to be generally equivalent to setback from other plat bouncaries.
