The following members were present: Mayor Hunt, Cniingilmg hrtyPri aV or Uogt- Neils and Schneider The to lowing members were absent: None Councilmember Neils introduced the following Resolution and moved Its adoption: RESOLUTION NO, 80-605 APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR JOHN SPAETH FOR "LI' -LIE POND" MPUD LOCATED SOUTH OF HIGHWAY 55, EASTERLY OF DUNKIRK LANE, AND NORTH OF 31ST AVENUE NORTH (80006) WHEREAS, John Spaeth has requested approval of a preliminary plat and conditional use permit for "Lillie Pond" MPUD for 3 industrial lots and a residential develop- ment containing 52 dwelling units on 41.16 acres located generally south of High- way 55, easterly of Dunkirk Lane and north of 31st Avenue North; and, WHEREAS, the•Planning Commission has -considered the request following a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for John Spaeth for preliminary plat and conditional use permit for "Lillie Pond" MPUD for 3 industrial lots and a residential development containing 49 dwelling units on 41.16 acres located generally south of Highway 55, easterly of Dunkirk Lane and north of 31st Avenue North subject to the following conditions: 1. Compliance with the City Engineer's Memorandum, 2. Completion of the required environmental assessment worksheet process prior to final platting. 3. Compliance with the City Park Dedication Policy in effect at the time of filing of the final plat relative to provision for trail corridor improve- ments and relative to payment of fees. 4. Written approval from the Department of Natural Resources for proposed alterations and filling of established wetlands. 5. Final alignment of New Medina Road to be reviewed and verified by the City Engineer. 6. Deisgnation of industrial area north of Medina Road as an outlot. 7. Incorporation of designated ponding area as an outlot by means of a covenant with the homeowners association. Resolution 0 80-605 Page 2 8. Approved density ratio of 2.2 units per acre for LA -1 and 3.4 units per acre for LA -2 based upon an assignment of 2 bonus points; the total number of dwelling units to be 49, consisting of 15 single family detached dwellings and 17 two family dwellings. Final density is exclusive of the designated 11 acres at or below the high water elevation, subject to final verification based upon approved permits for land reclamation and filling, prior to final plat. 9. Black Oaks Lane shall not intersect at Medina Road, but shall end in a cul-de- sac at the north end. 10. Elimination of Lot 6, Block 3 with the area incorporated into the remaining lots in Block 3. 11. Lots for all duplex units shall be reduced to the building size to permit more common open space area, in addition to the ponding area. 12. The attached dwellings shall be distributed throughout the development for a more creative design effect. 13. Zoning of the property for Planned Unit Development shall be finalized with the final plat per Section 9 of the Zoning Ordinance. 14. Minimum lot size on final plats for lots abutting Mapledell shall be 15,500 square feet. 15. Developer shall submit cross-section maps showing buffering of attached units on Dunkirk Lane with the final plat. 16.
