HomeMy WebLinkAboutCity Council Resolution 1980-585CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 25th day of August , 19 80. The following members were present: Mayor Hunt Councilmembers Davenport Hoyt. Neils and Schneider The following members were absent: Non- Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 80- 585 AUTHORIZING THE VACATION OF A PORTION OF THE DRAINAGE AND UTILITY EASEMENT ON LOT 7, BLK. 1, CIRCLE STAR BUSINESS CENTER 2ND ADDITION WHEREAS, a petition was received to vacate a portion of the drainage and utility easement on Lot 7, Blk. 1, Circle Star Business Center 2nd Addition; and WHEREAS, a public hearing with respect to said vacation was held on August 25, 1980 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 25, 1980; and WHEREAS, the Cour,;il did hold a public hearing on August 25, 1980 to inform any and all interested parties relevant to the vacation of a portion of the drainage and utility easement on Lot 7, Blk. 1, Circle Star Business Center 2nd Addition; and WHEREAS, it was determined by the City Council that a portion of the drainage and utility easement on Lot 7, Blk. 1, Circle Star Business Center 2nd Addition is not needed for utility/drainage purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of the drainage and utility easement on Lot 7, Blk. 1, Circle Star Business Center 2nd Addition be vacated: The 6 foot drainage and utility easement along the east 6 feet of the north 160 feet and along the north 6 feet of the east 157.8 feet of Lot 7, Blk. 1, Circle Star Business Center 2nd Addition. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Ngi , and upon vote being taken thereon, the following voted in favor thereo . Mavor Hunt.
