Pursuant to due call and notice thereof, a s ecial meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 11th da of
Auaust , 19 80 . The following members were present: r Run,

RESOLUTION NO. 80- 556
AMENDING SITE PLAN AND CONDITIONAL USE PERMIT FOR SUMMIT GEAR, I•NC. LOCATED AT
3131 VICKSBURG LANE (A-756)
WHEREAS, Summit Gear, Inc. has requested approval of a site plan amendment and
conditional use permit to locate a liquid nitrogen tank on the site of the
existing building at 3131 Vicksburg Lane; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
public hearing and recommends its approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY-
MOUTH, MINNESOTA, that it should and hereby does approve the request of Summit
Gear, Inc. for a site plan amendment and conditional use permit to locate a
liquid nitrogen tank on the site of the existing building at 3131 Vicksburg Lane
subject to the following conditions:
1. The permit is for either a single 3,000 or a single 6,000 gallon tank and
is subject to all applicable codes, regulations and ordinances, and viola-
tion thereof shall be grounds for revocation.
2. No other outside storage is permitted under this pera;it.
3. Tank to be located in_accordance with submitted site plan dated July 15, 1980.
4. Site shall be maintained in a neat and sanitary manner.
5. A chain link fence 6 feet in height minimum with a gate for security
purposes shall be erected in a manner so that the tank is.inaccessible to
the public.
6. Plans for the proposed tank shall be reviewed and approved by the Building
Inspection Department.

7. Corner posts, a minimum 5 inches in diameter and a minimum 36 inches high
filled with concrete are to be installed with the fence. -
8. Permit shall be renewed in one (1) year.
