HomeMy WebLinkAboutCity Council Resolution 1980-482CITY OF PLYMOUTH Pursuant to due call and notice thereof, a s ecial meeting of the City Council of the City of Plymouth, Minnesota, was held on the 28th day of July , 19 80 . The following members were present: Flayor Hunt, cilmembers Davenport, Hoyt and Schneider Tr*he following members were absent: —Councimem r Neils ter t,irt Councilmember Hoyt introduced the following Resolution and moved Its a option: - RESOLUTION NO. 80-482 APPROVING PRELIMINARY PLAT FOR "CIRCLE STAR BUSINESS CENTER 4TH ADDITION" FOR RAUENHORST CORPORATION AND K. B. DEVELOPMENT CO. II (80028) WHEREAS, Rauenhorst Corporation and K. B. Development Co. II have requested approval of a preliminary plat for approximately 5.66 acres in the southwest quadrant of the intersection of 28th Place North and Fernbrook Lane; and, WHEREAS, the Planning Commission has reviewed the proposal at a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY- MOUTH, MINNESOTA, that it should and hereby does approve the preliminary plat for "Circle Star Business Center 4th Addition" for Rauenhorst Corporation and K. B. Development Co. II subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. The dedication of Outlots A and C for the purpose of public right-of-way. 3. Elimination of the remnant Outlot B and Outlot D by combining them with Lot 1, Block 1, and Lot 1, Block 2 respectively. 4. Development Contract provisions limiting private driveway access to only 28th Place and the proposed public road connecting 28th'Place and 27th Avenue North. 5. General Development Plan shall be modified to eliminate<access onto Fernbrook Lane. 6. Park dedication requirements shall be satisfied with approved individual site plan approvals and prior to issuance of building permits for the respective sites. Resolution #80-482 Page 2 7. All dead and diseased trees shall be removed from the site at the sole expense of the developer. 8. City Attorney approval of all property title documents prior to final platting. 9. The north -south connection between 28th Place and 27th Avenue North shall be ordered and constructed as a public improvement project if it is not constructed by the developer by August, 1982 and the developer agrees to waive his rights to public hearing.
