HomeMy WebLinkAboutCity Council Resolution 1980-323CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of May , 1980 . The following members were present: Mayor Hunt, Councilmembers Hoyt, Neils and Schneider The following members were absent: CouncilmemberDavenport' Mayor Hunt introduced the following Resolution and moved is adoption: RESOLUTION NO. 80-323 APPROVING VARIANCES FOR TROY LAND COMPANY TO ALLOW BUILDING PERMITS ON PARCELS NOT ABUTTING PUBLIC STREETS IN SECTION 6 WEST OF TROY LANE AND PEONY LANE (80022) WHEREAS, Troy Land Company has requested variances from Section 500.3, Subdivision 4 of the City Code and from City Council Policy Resolution No. 75-664 regulating urban development to permit issuance of building permits on ten proposed parcels in Section 6 west of Troy Lane and Peony Lane which is currently unserviced; and, WHEREAS, the Planning Commission has reviewed said request and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Troy Land Company for variances from the City Subdivision Code and from the policy regulating urban development to permit issuance of building permits for ten parcels not abutting public streets in Section 6 west of Troy Lane and Peony Lane subject to the following.conditions: 1. Compliance with the City Engineer's Memorandum, with Item #3 deleted. 2. Appropriate information submitted reflecting the ability of soils to accomodate on-site septic systems. 3. Payment of park dedication fees in lieu of dedication in accordance with the park dedication policy and subdivision code in effect at the time of building permit issuance. 4. Appropriate perpetual access easement, as approved by the City Attorney, providing private street access to the proposed parcels to an approved intersection with Troy Lane shall be filed prior to issuance of building permits. 5. Granting of the waivers does not necessarily constitute approval by the City of the alignment of the access easement with -respect to possible future public roadway dedication, nor incur on behalf of the City any responsibility for maintenance. Resolution # 80-323 Page 2 6. No building permits to be issued until the division is filed with Hennepin County. 7. Land covenants and homeowners association documents shall be reviewed and approved by the City Attorney prior to issuance of building permits. 8. Approval is based on the find, per Policy Resolution No. 75-664(3) that the proposal will not cause an unreasonable burden upon the City of Plymouth in rpoviding services and utilities or cause a deleterious impact upon the natural environment; and finding that the variance criteria of the City Subdivision Code has been met.
