CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was a on a Sth day of

Councilmember Neils introduced the following Resolution and moved
s adoption: -
RESOLUTION NO. 80-293
APPROVING CONCEPT PLAN AND VARIANCE FOR "PLYMOUTH HILLS ESTATES" RPUD FOR FRANK
LARSON/GAR-LAR PROPERTIES (80013)
WHEREAS, Frank Larson/Gar-Lar Properties has requested approval of a concept plan
and variance for "Plymouth Hills Estates" RPUD on approximately 25.2 acres located
generally at the southwest corner of Vicksburg Lane and County Road 9; and,
WHEREAS, the City Council has determined that amendment of the adopted five year
Capital Improvements Plan should be approved to allow extension of utilities to
serve this project; and,
WHEREAS, the Planning Commission has reviewed the matter at a duly called public
informational hearing;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the concept plan and variance
for Frank Larson/Gar-Lar Properties for "Plymouth Hills Estates" RPUD at the
southwest corner of Vicksburg Lane and County Road 9 subject to the following
conditions:
1. Variance as to PUD minimum size is granted based upon consideration of
ordinance variance criteria.
2. Compliance with the City Engineer's Memorandum.
3. Utility improvements, in accordance with the City's Comprehensive Sewer and
Water Plans, must be extended by private development and not by public
.improvement.
4. Completion of the Environmental Assessment Worksheet process prior to final
platting.
5. Compliance with the provisions of Section 6 of the Zoning Ordinance relative
to subdivision and development in the General Flood Plain District.
6. Written approval by the Department of Natural Resources as to the alteration
of designated wetlands on the site.

7. Provisions for buffering and berming along County Road 9 and along
Vicksburg Lane.
8. Final alignment of public trails to be in accordance with City plans and
reviewed by the City Engineer.
9. Maximum density for the project shall be determined by the Planning
Commission after consideration of Conditions 1, 10, 11 and 12 of this
resolution and the City's bonus point and high water elevation policies,
and no density shall be given for low and moderate cost housing until
the development can demonstrate that such housing will be built on the
site.
10. Approval of extension of utility services to this parcel is recognized to
be beyond the City's Five Year Capital Improvement Program and is granted
by private development based on circumstances that this property must bear
substantial assessment for public improvements previously ordered (Vicksburg
Lane).
11. Preliminary plat submittal shall include a revised Concept Plan including
the Stivland parcel to the southeast and will show ultimate possible access
to that parcel from other than Vicksburg Lane.
12. Consideration shall be given in the preliminary plat to provide access
streets for continuity to the western property line.
