The following members were present: Mayor Hunt, rpWncllmembers Davenport, Hoyt, Neils and Schneider hT a following members were absent: None tai Councilmember Neils introduced the following Resolution and moved Its adoption: RESOLUTION NO, 80-277 APPROVING PRELIMINARY PLAT FOR JAMES HELD/OTHERS FOR "ARMSTRONG RIDGE" (80011) WHEREAS, James Held/Others have requested approval of a preliminary plat for 14 single family residential lots located north of Armstrong High School, south of 36th Avenue North at the intersection of Wellington Lane; and, WHEREAS, the Planning Commission has considered the request following a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of James Held/Others for "Armstrong Ridge", a preliminary plat for 16 single family residential lots located north of Armstrong High School, south of 36th Avenue North at the inter- section of Wellington Lane subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2. All building setbacks shall be in accordance with minimum ordinance require- ments. 3. No driveway access shall be permitted onto 36th Avenue North with the excep- tion of Proposed Lot 1. 4. Payment of park dedication fees in lieu of dedication for 16 lots in accordance with current Park Dedication Policy in effect at the time of filing of final plat. 5. No building permits to be issued until municipal utilities are physically available to the prap;erty. 6. Compliance with City Council Resolution No. 79-80 regarding subdivisions containing or adjacent to storm water holding areas. 7. Removal or demolition of all existing structures not in conformance with City Ordinance Standards with the exception of the existing single family dwellings on proposed Lots 1 and 15. Resolution # 80-277 10 Page 2 8. Removal of all dead or diseased trees at the owner's expense. 9. Prior to final platting, petitioner shall satisfy concerns of the City Attorney with respect to title and ownership. 10. Variances to be granted in width and area for Lots 5, 7, 10, 11, 13 and 14.
