HomeMy WebLinkAboutCity Council Resolution 1980-274CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was a on t e 21st da of April , 19 80 . The following members were present: mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following members were absent: N3ne Councilmember Neils introduced the following Resolution and moved is adoption: RESOLUTION NO. 80-274 APPROVING CONCEPT PLAN FOR "LILLIE POND" MPUD PROPOSED BY JOHN SPAETH (80006) WHEREAS, John Spaeth has requeste& approval of a concept plan for "Lillie Pond" MPUD for residential and non-residential development of approximately 40.5 acres located generally south of State Highway 55, east of Dunkirk Lane and north of 31st Avenue North; and, WHEREAS, the Planning Commission reviewed the matter at a duly called public informational hearing on February 27, 1980; and, WHEREAS, the City Council reviewed the matter on March 17, 1980 and referred the matter to the Planning Commission for further consideration; and, WHEREAS, the Planning Commission reconsidered the matter including additional testimony from neighboring property owners and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the concept plan for "Lillie Pond" MPUD for John Spaeth for approximately 40.5 acres south of Highway 55, east of Dunkirk Lane and north of 31st Avenue North subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2. Completion of the required Environmental Assessment Worksheet process prior to final platting. 3. Preliminary plat to reflect consideration of transition to neighboring single family residential areas; developer shall demonstrate conformance to the City's transition policy at preliminary plat stage, with through - section (profiles) graphics of the existing homes west of Dunkirk Lane. 4. Written approval from the Department of Natural Resources for any alteration of established wetlands and filling. 5. Final alignment of New Medina Road to be reviewed and confirmed by the City Engineer. Resolution # 80-274 ' Page 2 6. Extent of residential guiding south of Medina Road is determined to be approximately 23-25 acres of LA -1; approximately 3-5 acres of LA -2; and guiding for the 3 lots north of Medina Road shall be IP, as represented on the concept plan "A". 7. The final number of single-family detached units to be allowed shall be determined by approved reclaimable land area at the time of preliminary plat and site plan consideration. 8. Developer is to work with the City Engineer to determine if the high water elevation of the ponding area can be reduced. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt, . and upon vote being taken thereon, the following voted in favor thereat Mayor Hunt, CounciImember Is' Davenport, Hoyt, Neils and Schneider —' The following voted against or abstained: one Whereupon the Resolution was declared duly pass pt . _
