The following members were present: Mayor Hunt,, Councilmembers Davenport, Hoyt, Neils and Schneider The following mems were a sent: None uncilmember Schneider introduced the following Resolution and move its adoption: RESOLUTION NO. 80- 234 APPROVING VARIANCE FROM THE SUBDIVISION CODE AND SETTING CONDITIONS TO BE MET PRIOR TO FILING LOT DIVISION FOR KEITH GASPARD (80014) WHEREAS, the City Council has approved a lot division for Mr. Keith Gaspard who has also requested permission to build a single family dwelling on the newly created 5.02 acre lot which does not abut a public street; and, WHEREAS, the Planning Commission has reviewed the request and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY- MOUTH, MINNESOTA, that it should and hereby does approve the variance from the subdivision code to allow the construction of a single family dwelling on a 5.02 acre parcel which does not abut a public street subject to the following conditions; and approves the following conditions to be met prior to filing the property division with Hennepin County: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fee in lieu of dedication for one dwelling in accordance with the park dedication policy in effect at the time of building permit issuance. 3. Appropriate perpetual access easement, as approved by the City Attorney, providing access across the existing parcel to the approved intersection with Troy Lane shall be filed prior to issuance of a building permit. 4. Granting of the waivers does not necessarily constitute approval by the City of the alignment of the accts easement with respect to possible future public roadway dedication, nor incur on behalf on the City any responsiblity for maintenance. 5. No building permit to be issued until the subdivision is filed with Hennepin County. 6. Appropriate documents shall be filed on both parcels indicating that in conjunction with this division, conceptual documents have been placed on file with the City for future reference. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the following voted in favor thereof: -Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following voted against or abstained: None Whereupon the Resolution was declared duly passed and a opte
